Hoke LLC Established Connecticut Insurance Allocation Law in Vanderbilt Talc/Asbestos Coverage Action


Hoke LLC prevailed in the Vanderbilt Minerals case which resolved all or nearly all of the disputed aspects of insurance allocation law in Connecticut. The Connecticut Supreme Court described its opinion setting forth the legal standards for long-tail asbestos, talc, pollution and other coverage matters as one of “first impression.”

Hoke LLC was lead trial and lead appellate counsel. The case was identified as the first “Most Important Case to Watch in 2019” in the U.S. by leading insurance website Insurance Law360.

Hoke LLC successfully represented the policyholder, Vanderbilt Minerals, LLC, at trial over a two-year period and throughout the appellate process against approximately 30 insurance company defendants.

The opinion describes the case as a “massive coverage dispute” involving historical insurance policies from 1956 to 2007, which produced the most pleadings ever filed in a Connecticut state court civil action. Since the decision, the client has been successful in reaching closure with the defendants on substantially all remaining issues.
